Competition Use Agreement

Required for Competition Vehicles

This agreement must be completed before applying any calibration that modifies emissions-related systems on a vehicle used exclusively for sanctioned competition events. This agreement creates a legally binding certification that the vehicle will never be operated on public roads.

Legal Background

The Clean Air Act provides a limited exemption under 40 CFR § 85.1703 for vehicles used solely for competition which are not used on public streets or highways. This exemption requires that:

The vehicle is used exclusively for competition purposes
The vehicle is never operated on public roads or highways
The vehicle is properly documented as a competition-only vehicle

By completing this agreement, you certify under penalty of perjury that your vehicle meets these requirements and you accept full legal responsibility for ensuring continued compliance.

You must acknowledge ALL of the following statements. Each certification is legally binding.

Not Street Legal: I understand that after applying emissions-related calibration modifications, this vehicle will NOT be legal for use on public roads or highways under federal law.De-Registration: I certify that this vehicle is or will be de-registered for street use with my state's Department of Motor Vehicles, or has been issued a "competition only" or "off-highway" registration status.No Public Road Use: I certify that this vehicle will NEVER be operated on any public road, street, or highway, including for transportation to/from racing venues. The vehicle will only be transported via trailer or other means.Permanent Conversion: I understand that this vehicle is being permanently converted for competition use only. Restoring the vehicle to street-legal status would require reinstallation of all original emissions equipment and OEM calibration.Personal Liability: I accept FULL personal responsibility for ensuring this vehicle is used in compliance with all applicable federal, state, and local laws. I agree to indemnify and hold harmless PulseWidth Tuning and UBT Performance, LLC from any claims, damages, or penalties arising from my use or misuse of this vehicle.Federal Law Acknowledgment: I understand that violating the Clean Air Act by operating an emissions-modified vehicle on public roads may result in civil penalties up to $45,268 per vehicle and potential criminal prosecution, including fines and imprisonment.State Compliance: I understand that my state may have additional emissions regulations beyond federal law, including California Air Resources Board (CARB) requirements, and I am solely responsible for compliance with all applicable state and local regulations.

PulseWidth Tuning is a DBA of UBT Performance, LLC. This agreement is a legally binding document. False statements may constitute perjury and may result in legal action. Retain a copy of this agreement for your records.
